These Terms & Conditions of Sale (“Terms”) govern the purchase of services and products offered by FlowUp Palma, a commercial brand owned by KV SPA SL, a Spanish limited liability company (NIF B70990528), located at Calle Carnisseria 3B, 07001, Palma de Mallorca, Illes Balears, Spain (“we”, “our”, or “FlowUp”). By booking a session, purchasing a package, or ordering a product, you (“Client”, “you”) agree to these Terms.
1. Services Offered
FlowUp provides:
- Pilates 24/7 (Kiosk Pro sessions, subscription passes, discovery passes)
- Holistic Therapies including Renata França Lymphatic Drainage, Vibria Therapy, Access Bars, Reflexology, and Acupuncture
- Nutrición Integrativa sessions
- Products via our boutique (shakers, grip socks, supplements, accessories)
All services are offered to adult clients, and our therapies are intended for wellness purposes and are not a substitute for medical treatment.
2. Booking & Payment
- Bookings are made via our website, by phone, or in person. Online bookings are managed through Glofox, a secure third-party platform specialized in wellness and fitness reservations.
- Prices are indicated in EUR and include applicable taxes.
- Payment can be made online via Glofox, by card, or in-studio.
- Deposits or full payments may be required at the time of booking for certain services or packages.
- Packages (e.g., 3/5 sessions) are valid for 3 months from the date of purchase unless otherwise stated.
3. Cancellation & Rescheduling
- Individual sessions: Cancellations must be made at least 24 hours in advance. Late cancellations or no-shows may result in full charge of the session.
- Package sessions: Missed appointments will be deducted from the package unless rescheduled 24 horas de antelación.
- FlowUp reserves the right to cancel or reschedule sessions due to unforeseen circumstances, offering clients a full refund or alternative date.
- Glofox booking: Clients must respect the platform’s booking rules and notifications. Any technical issues should be reported to FlowUp promptly.
4. Refund Policy
- Single sessions: Non-refundable if attended or missed without proper notice.
- Packages & subscriptions: Non-refundable once purchased, except in cases of studio closure or medical emergencies, subject to proof.
- Products purchased in-store or online are subject to Spanish consumer law regarding returns and exchanges.
5. Client Responsibilities & Contraindications
Clients must:
- Disclose any health conditions, allergies, or pregnancy prior to treatment.
- Follow practitioner instructions during sessions.
Contraindications include (but are not limited to):
- Acute illness or infection
- Severe chronic conditions
- Pregnancy for certain treatments (specific restrictions apply)
6. Privacy & Data Protection (GDPR Compliance)
- FlowUp collects personal data (name, email, phone number, health information) solely for service delivery, booking, and marketing purposes.
- Online bookings via Glofox may require additional information (email, phone, payment details). FlowUp ensures that Glofox complies with GDPR standards for data security and privacy.
- Data is stored securely and never shared with third parties without consent, except when required by law.
- Clients may request access, correction, or deletion of their data at any time via flowup@flowuppalma.com.
- By booking a session or purchasing a product, clients consent to the processing of their data in accordance with EU GDPR.
7. Liability
- FlowUp provides services with care and expertise; however, we are not liable for personal injury, illness, or loss resulting from undisclosed medical conditions or failure to follow practitioner guidance.
- Therapies are not a replacement for medical diagnosis or treatment.
8. Intellectual Property
All content on FlowUp’s website, including text, images, logos, and design, is protected by copyright. Clients may not reproduce, distribute, or use any content without prior written consent.
9. Governing Law & Jurisdiction
These Terms are governed by Spanish law. Any disputes arising from these Terms or our services shall be submitted to the courts of Palma de Mallorca, Spain.
